Selling on eMAG as a foreign company

Listing on eMAG puts you in front of Romanian consumers directly, which is exactly what triggers Romanian producer responsibility. Whether you ship from your own warehouse abroad or through eMAG's fulfilment, the packaging that reaches the Romanian customer is placed on the Romanian market and has to be declared here.

Why eMAG sellers get asked about this

  • It is a domestic marketplace, so the whole flow is squarely inside the Romanian market.
  • Romanian consumers, Romanian delivery addresses, Romanian returns.
  • Larger sellers are increasingly asked for compliance evidence during onboarding or review.
  • Products in categories such as electronics and appliances trigger WEEE and battery duties as well as packaging.

What has to be in place

DutyDeadline or trigger
Romanian producer registrationBefore you place goods on the market
Contract with a licensed organisation (OIREP)Before the first reporting month
Monthly Environmental Fund declaration25th of the following month, zero months included
Annual data report31 March for the previous year
Authorised representative in RomaniaFor any producer without an establishment here

Fulfilment does not move the obligation by itself

Storing stock in a Romanian warehouse and letting the marketplace ship it is a logistics arrangement. The producer is the party that places the goods on the market, and that stays you unless a written arrangement explicitly transfers the duty.

What fulfilment does change is the packaging mix: part of the transport packaging may be added by the warehouse. We separate that when building the reporting base, so you declare what is actually yours.

Frequently asked questions

Do we need a Romanian company to sell on eMAG compliantly?
Not for the environmental obligations. You appoint an authorised representative established in Romania; we act in that role.
We use eMAG fulfilment. Who declares the shipping box?
Whoever's packaging it is. We separate your own packaging from packaging added by the warehouse when we build the reporting base.
We sell appliances and electronics. Is packaging enough?
No — those categories usually also trigger WEEE and battery registration. We check the full picture in the assessment.
